Designs Service Terms and Conditions
Before a
project begins, clients sign and return this Terms and Conditions project
agreement to Camellia Designs. The client agrees to these terms on
copyrights, refunds or cancelled projects, third-party companies, and that
there are no warranties.

Copyright
and Distribution
The client is granted copyright to the text, original art and other work
Camellia Designs creates for custom their project. The client may
distribute the custom work, modified or intact, to any projects and
parties, and in any media formats.
We may
request the client distribute this fine print text in their credits or
documentation, or anywhere our original artwork or photo art work appears
in their projects: "Designs by Camellia Design www.camelliasoftware.com/designs"
Camellia Design retains all rights for any copyrighted images from our
10,000+ photos and vector portfolio used in the project. Please

us for the portfolio list. These images are used on a "one time
Royalty-free use only". The copyright and distribution rights for
these images remains with the artists of Camellia Design.
The client has right to modify and distribute any of the custom work,
except for the original photos and original artwork copyright retained by
Camellia Design. If Camellia Design's copyrighted work is altered, it must
retain its suitability for General Audiences, as we are General Audiences
writers and artists.
All client's projects and our work for the project remains confidential
between Camellia Design and the client. We may request the client's
permission for a testimonial, or to publish thumbnail images of the custom
project for Camellia Design promotions.
Camellia Design nor Camellia Software will not distribute, sell, rent or
trade the custom original project files to other parties, in any media or
format.
Refunds or Cancelled Projects
Since projects can be canceled at anytime by either party due to client
dissatisfaction, there are no refunds, credit or exchanges, for any type
of Fixed Bid or Hourly payments. Thank you for your understanding.
No Warranties
Camellia Designs and Camellia Software disclaim all warranties for any
provided products or services. No product upgrades, enhancements, or
additional services are provided after a purchase or finished custom
project. Camellia Designs and Camellia Software are not responsible for
any charges beyond the purchase price collected by Camellia Designs at the
time of purchase. The products, service, and any documentation are
provided "as is", and provided without warranty of any kind,
either expressed or implied, including, without limitation, the implied
warranties of merchantability or fitness for a particular purpose. In no
event shall Camellia Designs, Camellia Software, or the regents or
contributors of the products be liable for any direct, indirect,
incidental, special, exemplary, or consequential damages (including, but
not limited to, procurement of substitute goods or services; loss of use,
data, or profits, or business interruption) however caused and on any
theory of liability, whether in contract, strict liability, or tort
(including negligence or otherwise) arising in any way out of the use of
this products, even if advised of the possibility of such damage.
Third-Party
Companies
We do not subcontract or outsource work for your project, all work is done
by the staff of Camellia Designs.
Third-parties
you have hired, working on your project with us include, but are not
limited to, our photography or illustration stock image agencies,
printers, photographers, website programmers, shippers, or other design
firms. While we are happy to help facilitate arrangements with
third-parties, we are in no way responsible for the third-party’s
project portions. If you need our advice, we are happy to suggest third
party companies, but by these suggestions we do not imply any testimonial
for experience with their services, nor a professional recommendation, nor
an official affiliation with that third party company.
